Spokane Joint Replacement Center, Inc. (“SJRC,” “we,” “us, “our”) is committed to protecting the privacy of users of the Site, Application, and our Services. This Privacy Policy governs the manner in which the Application and Site collect, use, maintain, and disclose information collected from users (each, a “User”) of the Ortho Research Master Application and www.orthoresearchmaster.com. This Privacy Policy applies to the Site, the Application, and all SaaS products and services offered by SJRC (“Services”).

Collection of Information:

         Personal Identification Information

We may collect Personal Identification Information (“PII”) from Users in a variety of ways, including, but not limited to, when Users visit our Site or Application, fill out a form, and in connection with other activities, services, features or resources we make available on our Site and Application. PII is any information that can be used to individually identify you. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply PII, except that it may prevent them from engaging in certain Site or Application related activities. We collect PII such as your name, email address, billing address, phone number, instant messaging ID, credit card information, other payment information, Personal Health Information (discussed below), among other information.

         Non-Personal Identification Information

We may collect non-personal identification information (“non-PII”) about Users whenever they interact with our Site or our Application. The non-PII may include the browser name, the number and type of devices you use to connect to the Application or Site, as well as information about the operating systems on those devices, and other technical information about Users means of connection to our Site or Application, such as the operating system and the Internet service providers utilized and other similar information.

         Cookies and Log Data

Our Site and Application may use “cookies” for site statistics. We use cookies to monitor traffic, improve the Site and Application, and make it easier to use and more relevant. Through our use of cookies, we may recognize your browser or device, learn more about your interests, keep track of your specified preferences, conduct research and diagnostics to improve our offerings, provide you with essential features and services, prevent fraudulent activity, improve security, and deliver content (including ads relevant to your interests on our Site and third-party sites).

How We Use Collected Information
We may collect and use Users’ personal information for the following purposes:

  • To provide you with information, products, or services that you request from us or which we consider are similar to those you have already purchased or inquired about;

Protecting Health Information
As a provider of software as a service platform for the entry, tracking and analysis of clinical research studies, SJRC’s customers are health care providers and subject to laws and regulations governing the use and disclosure of Private Health Information. In the United States, the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), the Health Information Technology for Economic and Clinical Health of 2009 (“HITECH”), along with the regulations adopted under those statutes, and similar state laws (where those laws are more stringent than HIPAA) govern the handling of Personal Health Information. Health care providers are considered to be Covered Entities under HIPAA and are subject to its rules regarding Personal Health Information. If a provider delegates some of its work to a third party, and that party must access Personal Health Information in order to perform the work, then such party is considered by HIPAA to be a Business Associate and is subject to the same rules regarding the protection of Personal Health Information as the Covered Entity. To enforce protection, HIPAA requires Covered Entities to execute a “Business Associate Agreement” or “BAA” with each of its Business Associates. As a Business Associate, we are required to use reasonable and appropriate measures to safeguard the confidentiality, integrity and accessibility of Personal Health Information that is stored and processed on behalf of Covered Entities. From time to time, the terms of SJRC’s standard BAA may be posted on the Site and Application.

How We Protect Your Information
SJRC is committed to protecting the security of your PII and takes certain security measures to help protect such information. SJRC maintains commercially reasonably physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of PII. Understand, however, that while we do our best to safeguard your PII once we receive it, no system of storage or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.

Please remember that you control what PII you provide while using the Site, Application, and Services. Ultimately, you are responsible for maintaining the secrecy of your identification, passwords and/or any PII in your possession for the use of the Site, Application, and/or Services. We urge you to take every precaution to protect your information when you are on the Internet, or when you communicate with us and with others through the Internet. Change your passwords often, use a combination of letters and numbers, and make sure you use a secure browser. Sharing of Information
SJRC takes your privacy extremely seriously. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and Users with our business partners, trusted affiliates, and advertisers for the purposes outlined above. We have third-party agents, subsidiaries, affiliates and service providers who or which perform functions on our behalf, including, but not limited to hosting, content syndication, content management, technical integration, marketing, analytics, and customer service. These entities may have access to PII if needed to perform their functions for SJRC but are not permitted by us to use it for other purposes.

We may also use or disclose PII and non-PII if required to do so by law or on the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us, the Site, or the Application; (b) protect and defend our rights or property, the Site, the Application, or our Users, or (c) act to protect the personal safety of us, Users of the Site, Application, or the public.  As part of this effort, we may release account and other PII or non-PII with other companies and organizations for fraud prevention and detection or credit risk reduction.

Third Parties
Some areas of the Site and Application are powered by third parties. These web pages, while having the SJRC “look and feel,” reside on the third party’s server and are governed by the privacy policies of such third party. Users may also find advertising or other content on our Site or Application that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors, and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site or Application.

In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site or Application, is subject to that website’s own terms and policies. This Privacy Policy does not apply to information that you may submit to third-party sites and mobile applications that may be linked to or from the Site or Application.

Length of Storage of PII
The time period for which we keep information varies according to what the information is and the purpose for which it is used for. In some cases, there are legal requirements to keep data for a minimum period. Unless there is a specific legal requirement for us to keep the information, we will retain it for no longer than is necessary for the purposes for which the data was collected or for which it is to be further processed.

Children and Privacy
We believe in the importance of protecting the privacy of children online. The Children’s Online Privacy Protection Act (COPPA) governs information gathered online from or about children under the age of 13. Neither the Site, Application, nor Services are not intended to solicit information of any kind from children under age 13. Unless otherwise disclosed during collection, and with parent or guardian consent, SJRC does not knowingly collect PII from children under 13 years of age. If you are under the age of 13, do not provide any PII to SJRC.
